Wrongful Death
Introduction
What happens, however, when a person dies before they can bring a lawsuit down on someone else? Well, in the older days the only thing that was possible was for the people that were close to the deceased to simply forget about it and move on with their lives. This was hardly acceptable to them, but unfortunately there was nothing they could do about it. Nowadays, though, there is a provision in place that allows the lawsuit to go forward. This provision is known as wrongful death.
Wrongful Death
There are a number of different provisions under wrongful death that can be used, but for the purposes of providing a brief introduction it is good enough to know that under the wrongful death rule the family of a deceased person has the ability to file a lawsuit on the behalf of a deceased person. So, if a person dies from an injury that he or she sustained at work then his or her immediate family has the right to sue the company on the individual’s behalf.
There are a number of different conditions that need to be satisfied for this to happen. First, the defendant or prospective defendant needs to actually be responsible for the deceased’s passing. Not in a deliberate way, but if the defendant is a construction company then if wrongful death is to be used it must be proven that the construction company was directly and inadvertently responsible for the death of the deceased.
Applications
There are a number of different situations where wrongful death may be used, and the most common occurrences are discussed below.
Death at Scene: If a person is involved in an accident at the workplace that ends up causing his or her death instantaneously or soon after then the rules of wrongful death can be used in order to allow the family of the dead worker to sue the company for damages related to the death, and subsequent loss of security that the family has suffered because of the unsafe working conditions that the worker was placed in to cause the accident.
Terminal Illness: While a number of terminal illnesses take a very long time to run their course it is possible for a terminal illness to take its effect very quickly. A number of acute cancerous cases are known to do this, for example, and it is quite possible that the patient might die of the illness before any discussion about a lawsuit is even started. In this situation, the family also has the ability to use wrongful death.

There are a number of different legalities involved in the filing of a lawsuit under wrongful death and depending on which country you live in, the processes involved are going to be different.
