Civil Law Attorneys deal with cases pertaining to civil law, as opposed to criminal law. Civil law suits deal with complaints between individuals or parties unlike criminal trials, which deal with complaints of the state against an individual. The party bringing the lawsuit is an individual or group who has had an unjust or unlawful act committed against them by another individual or group. In general, most civil suits result in an awarding of damages to make up for injuries or losses sustained, a division of property, or custody rights. These differ from criminal trials, which usually result in some sort of punishment such as incarceration. Verdicts are rendered based on “preponderance of evidence.” It is not uncommon for civil cases to be presented solely before a judge without the inclusion of a jury. In most cases, a judge will meet with the attorneys for both plaintiff and defendant before the trial begins in the hopes of working out a solution without having to involve a lengthy an expensive trial.
Examples of civil cases include but are not limited to: divorce and family issues, personal injury trials, and class action lawsuits. A loser may appeal to a higher court if they feel errors in the handling of the case occurred.
