Divorce attorneys and mediations attorneys are two sides of the same coin. One handles the legal issues while the divorcing couple sits in their opposing corners. The other enlists the spouses in the process of dissolving the marriage. These two approaches are means to the same end—the dissolution of the marriage. 

The divorce attorney is the best representative in cases where the two parties are hostile and the parting between them less than amicable. Both spouses hire a divorce attorney to handle the division of assets, custody, and any other issues. Oftentimes, the divorcing couple can avoid crossing paths in a courtroom; the attorneys appear in their place. 

Mediation, however, requires that the couple spend time with one another—in the presence of the mediation attorney. Together, the three of them divide the assets, create a custody arrangement, and amicably handle any other aspects of the divorce. Using a mediation attorney allows a couple to circumvent the courtroom, and in most cases, speed up the dissolution of the marriage.

This choice of attorneys is not set in stone. If an amicable divorce becomes hostile during mediation, then divorce attorneys can take over. A once hostile divorce that cools can be turned over to a mediation attorney. The choice of either a mediation attorney or a divorce attorney hinges on the divorcing couple’s relationship throughout the process.
