A patent attorney, sometimes known as a patent lawyer or patent agent, is someone who is specially trained to assist clients in all things associated with patent law and practice, including but not limited to obtaining patents and filing oppositions. Different countries have different requirements for attaining this title, and often times a general legal practitioner can be equally qualified to serve as a patent attorney.

In contrast, in many countries a trademark attorney is specially educated to work specifically in trademark law. Some of their duties include advising on the selection of new trademarks, filing and registration procedures, use of registered trademarks, handling oppositions and dealing with infringement issues. Trademark application forms are often confusing and errors cannot be fixed once they are filed nor will refunds of application fees be issued, thus making it preferable for companies and individuals to have the aid of a professional rather than concern about the mistakes they may make when attempting to do it themselves. Often large companies with many trademark interests will employ a trademark attorney specifically for their own dealings. Special qualifications are not required in the United States, where any lawyer licensed to practice may serve as a trademark attorney.
