{"id":780,"date":"2009-07-28T14:20:41","date_gmt":"2009-07-28T18:20:41","guid":{"rendered":"http:\/\/209.197.111.4\/legal-news\/?p=780"},"modified":"2009-10-22T14:21:12","modified_gmt":"2009-10-22T18:21:12","slug":"supreme-court-revives-wardrobe-malfunctions-case","status":"publish","type":"post","link":"https:\/\/www.legalinfo.com\/legal-news\/supreme-court-revives-wardrobe-malfunctions-case.html","title":{"rendered":"Supreme Court Revives &#8216;Wardrobe Malfunctions&#8217; Case"},"content":{"rendered":"<p>The Supreme Court revived a possible $550,000 fine against broadcast network CBS, following up on a ruling from last week, for having shown a split-second image of Janet Jackson&#8217;s breast during a Super Bowl halftime show in 2004.<\/p>\n<p>The Philadelphia court had ruled that the Federal Communications Commissions (FCC) did not give broadcasters enough notice of a policy change on \u201cfleeting images\u201d of \u201cindecency\u201d and that the nudity was probably accidental.   <\/p>\n<p>The final conclusion will be reevaluated by the appeals court.  The Supreme Court backed the FCC&#8217;s zero-tolerance policy last week regarding broadcasting of \u201cfleeting expletives.\u201d<\/p>\n<p>The FCC had received many complaints after the exposure occurred on televisions.  The Parents Television Council was one group which praised the justices for \u201csiding\u201d with the families in this case.<\/p>\n<p>CBS, however, downplayed the court&#8217;s order.  \u201cThe Super Bowl incident, while inappropriate and regrettable, was not and could not have been anticipated by CBS,\u201d said the network.<\/p>\n<p>Last week, the high court ruled that the FCC could fine broadcasting stations who aired the F-word during prime time television.  Even if the show is live, and the word is said by a guest, it would remain.
