Negligence Lawsuit Settled By Midwife

A negligence lawsuit has been settled by a midwife after a lawsuit was filed against her by the mother of a baby whose birth she helped with. The midwife from Mendon was accused of violating midwifery regulations in 2004 with two births, and as a result of this she ended up losing her license.

The case has now been dismissed by stipulation of all parties involved according to court records, although there is no indication with regards to what the terms of the settlement actually were. However, the settlement means that both of the cases in relation to the two births have now been settled.

The midwife, Roberta Devers-Scott, has filed her own federal lawsuit in a bid to get her licence reinstated to practice in Vermont. However, this lawsuit and decision is still pending.

The second lawsuit that had been filed against the former midwife claimed that as a result of her negligence the baby was born with brain damage. However, an attorney working for the midwife stated: “I can say there was certainly no acknowledgment of wrongdoing,”
